Data Ownership
All tracking data generated by Tracking Guardian devices remains the property of the customer.
Engineer M8 acts solely as a data processor, storing and presenting tracking information for the purpose of providing the Tracking Guardian service.
Customers retain full rights to access, export, and request deletion of their data in accordance with applicable law.
Data Usage
Tracking Guardian data is used exclusively for:

Providing live and historical tracking services

Device health and connectivity monitoring

Service reliability and fault investigation
-
Compliance and audit trail generation
Tracking data is not used for marketing, profiling, or behavioural analysis.
Personal Data
Tracking Guardian is designed to monitor assets, vehicles, or equipment, not individuals.
Where tracking data may be associated with a person (for example, a vehicle assigned to an employee), the customer is responsible for:

Informing relevant individuals

Ensuring lawful use under applicable employment and data protection laws
Engineer M8 does not determine how customers use tracking data and does not monitor individuals directly.
Data Security
Engineer M8 implements appropriate technical and organisational measures to protect tracking data, including:

Encrypted data transmission

Secure authentication controls

Restricted system access

Monitoring for unauthorised access
Access to tracking data is limited to authorised users within the customer’s account and essential Engineer M8 support personnel when required for service delivery.
Data Retention
Tracking data is retained in line with the customer’s service plan and operational requirements.
Retention periods may vary depending on:

Subscription level

Regulatory or compliance needs

Storage and reporting features enabled
Customers may request clarification or adjustment of retention periods where applicable.
Data Deletion
Upon service cancellation or written request:

Live data collection will cease

Access to the tracking portal will be removed

Data will be deleted or anonymised in line with Engineer M8’s data retention policy and legal obligations
Some records may be retained where required by law or for legitimate business purposes, such as billing or dispute resolution.
Third-Party Access
Engineer M8 does not sell, rent, or trade tracking data.
Tracking data is not shared with third parties except where:

Required to deliver the Tracking Guardian service

Required by law or regulatory authority

Explicitly authorised by the customer
All service components operate within Engineer M8–controlled systems and agreements.
System Availability
Tracking Guardian is provided on a best-efforts basis, subject to:

Mobile network availability

Environmental conditions
-
Power supply at the device location
Temporary interruptions may occur and do not constitute a breach of service unless otherwise stated in contractual terms.
Compliance
Tracking Guardian is designed to support compliance with relevant data protection and operational standards, including:

Data Protection Act 2018
Customers remain responsible for ensuring their own use of the system complies with local laws and internal policies.
Liability Limitation
Tracking Guardian provides monitoring and reporting services only.
Engineer M8 is not responsible for:

Actions taken (or not taken) based on tracking data

Losses resulting from inaccurate location data due to signal, environment, or device interference
-
Consequential or indirect damages unless required by law
Full liability terms are governed by the customer’s service agreement.
Updates to This Appendix
Engineer M8 may update this Legal & Privacy Appendix from time to time to reflect:

Security enhancements
The latest version will always be available through the CMS client area or on request.
